Strange tail light modulating action?

The previuous owner installed a piece that lets the tail light flash quickly when the brake is first applied, and then it settles to just a brake light (I think). However, I have been told, by those riding behind me, that it seems to act erratically(erotically I could live with, lol). Today, I had two fellow bikers riding behind me and they commented that this unit seemed to go on in all kinds of situations, or not, and then work as a regular light. One thought there may be an adjustible mercury switch that detects when i slow down, but it seems too sensitive/broken.

Any thoughts but most of all, where might this unit be located? I like the concept but having a flashing going on willy nilly seems counter productive.

If it is the same as I have it is called a - Brake LED ! made by Gizmo mill. It is located (installed) in your tail light. No mercury switch just some kind of LED light with a computer chip. Are you sure your not touching the front or rear brake lever while driving and not realizing it ? ( I'll bet thats whats happing ) It does not take much pressure to set it off. And it does flash like wild for about 2-3 seconds intill it will stays solid red. Keep us posted.
